In the second instance, the NMHH confirmed the result of the 900 MHz frequency auction

Telenor has classified its appeal as a business secret. The other two operators disputed the possibility for the new entrant to participate in the auction process and the requirement to provide it with domestic roaming services.

The Office of the National Media and Communications Authority (NMHH) launched the auction procedure for the 900 MHz frequency band back in August last year. Following the announcement of the results on 31 January this year, the mobile operators already on the market, Magyar Telekom, Telenor and Vodafone, appealed against the decision, while RCS & RDS SA in Romania and Viettel Group in Vietnam, which had previously been excluded from the auction, did not exercise this right.

Gábor Mátrai, Deputy Chairman of Communications of the National Media and Communications Authority, upheld the previous decision of the authority in the second instance proceedings within the time limit provided by law. Accordingly, a new service provider, the consortium of Magyar Posta Zrt. – Magyar Fejlesztési Bank Invest Zrt. – Magyar Villamos Művek Zrt., Can enter the three-player mobile market.

With the decision of the appellate authority, the decision on the outcome of the auction became final, but the parties have an additional right of appeal: the appellate decision can be appealed to the Metropolitan Court within 30 days.
