The internet has become restricted

In the future, courts may order the blocking of access to certain Internet data on foreign servers. The amendment to the criminal law, also initiated by the government, was passed by parliament on Monday with the support of the Fidesz-KDNP. The change allows data on foreign servers to be made temporarily or permanently inaccessible. If the court gives a final order to make the electronic data permanently inaccessible, its enforcement will be transferable to the country in whose territory the hosting provider is established or established.

The transfer will be agreed between the justice ministers of the two countries, informing the foreign party that if the state is unable to comply with the deletion of the data within one month, the court will order enforcement by blocking.

Hungary must receive the same requests from foreign parties and the court must decide on enforcement. Enforcement ordered on the basis of a foreign judgment must be terminated immediately if the enforceability of the foreign judgment has ceased.

The provision is effective from July, however, the law allows a grace period of six months for cases where it is not the hosting provider that needs to remove the offending content, but the ISP to block it. After January 2014, 1, however, the ISP will be able to impose a fine to block.

The law justifies the growing number of crimes committed via the internet, and children are particularly vulnerable. Therefore, the government has initiated the change to allow action to be taken against the sexual abuse, exploitation and child pornography of minors. [mti]
