A fine of five million for DIGI Kft
DIGI Kft. Removed certain television channels from its program packages in an infringing manner before notifying the subscribers, before the agreed deadline. The National Media and Communications Authority (NMHH) fined the service provider five million for infringing behavior.
In the protection of subscribers, NMHH launched an ex-officio investigation to find out whether the service provider had complied with the law. During the investigation, the NMHH found that DIGI had not complied with the legislation in several respects.
The service provider did not comply with its own general terms and conditions (GTC) when it removed the Discovery channels from the program packages without prior notice without prior notice. This has been to the detriment of subscribers who have contracted with the service provider, even for several years, in the belief that the channels they prefer will remain in the chosen package for at least the time agreed by the service provider. And by not notifying them of the change in advance, it deprived subscribers of the opportunity to prepare for the change and switch to another provider in time.
In addition, the service provider was late in notifying NMHH, as it had to notify the authority of the change to the software package 30 days before the changes were introduced.
